Australian Education Services for Overseas Students Act 2000 and National Code 2018 (Australia) s46B-46D: ss 46B to 46D Provider default: notices and discharge within 14 days

When a provider defaults (does not start a course on the agreed day, or stops providing it before completion, including because of a sanction) it must notify, in writing, its ESOS agency and the TPS Director within 3 business days, with the circumstances, the affected students and how it will discharge its obligations, and must notify the affected students. It must discharge its obligations to each student within 14 days after the default day by arranging a written-accepted alternative place at its own cost or paying the prescribed refund.
