Australian Consumer Law (Competition and Consumer Act 2010 Schedule 2) s54: s 54 Supply goods of acceptable quality

A business supplying goods to a consumer in trade or commerce (other than by auction) guarantees that they are of acceptable quality: as fit for all purposes for which such goods are commonly supplied, acceptable in appearance and finish, free from defects, safe and durable as a reasonable consumer fully aware of their condition, including hidden defects, would regard as acceptable, having regard to their nature, price, packaging and label statements, representations by the supplier or manufacturer and other circumstances. Defects specifically drawn to the consumer's attention before purchase (including by a transparent written notice displayed with the goods) do not count, nor does damage the consumer caused or abnormal use, nor defects an examination the consumer made ought to have revealed.
