Part 2-2: general duties of accountable authorities, accountable authority instructions, government policy, and the general duties of officials (sections 14 to 32) – Australia Public Governance, Performance and Accountability Act 2013 (PGPA Act)

Australia Public Governance, Performance and Accountability Act 2013 (PGPA Act) 19: Duty to keep the responsible Minister and Finance Minister informed: activities of the entity and subsidiaries, reports and information required, notice of significant decisions and of significant issues that may affect or have affected the entity, within the Minister's time limits

What does 19 require?

An accountable authority owes its responsible Minister a running account of what the entity and its subsidiaries are doing. Beyond that, it must hand the responsible Minister or the Finance Minister whatever reports, documents and information about those activities either Minister calls for, inside the time limit that Minister sets; tell the responsible Minister promptly after taking a significant decision about the entity or a subsidiary; give reasonable warning of any significant issue that could affect them; and report promptly once aware of a significant issue that has affected them. For an entity attached to a court or tribunal only administrative matters are covered. The rules may say what counts as significant. Where enabling legislation exists the duty yields to it, disclosure prohibitions in other Commonwealth laws override it, and a Minister's other information powers are untouched.
