Part 2-2: general duties of accountable authorities, accountable authority instructions, government policy, and the general duties of officials (sections 14 to 32) – Australia Public Governance, Performance and Accountability Act 2013 (PGPA Act)

Australia Public Governance, Performance and Accountability Act 2013 (PGPA Act) 18: Duty when imposing requirements on others: take into account the risks associated with the use or management of the public resources concerned and the effects of imposing the requirements

What does 18 require?

An accountable authority that places obligations on others, for instance grant recipients, contractors or fellow entities, concerning the public resources it is responsible for must first weigh two things: the risks that attach to how those resources will be used or managed, and the consequences of imposing the obligations. The provision is a brake on reporting and compliance burdens out of proportion to the risk involved.
