Australia National Consumer Credit Protection Act 2009 (Cth) s115-119: ss 115 to 119 Make a preliminary assessment of unsuitability within 90 days before giving credit assistance

Before suggesting or assisting a consumer to apply for a particular credit contract or credit limit increase, or to remain in a contract, a licensee must, within the previous 90 days, make a preliminary assessment that specifies the period covered and assesses whether the contract will be unsuitable for the consumer, and must assess it as unsuitable if the tests in s 118 or s 119 are met.
