A PCBU must consult workers who are or are likely to be directly affected, including contractors, on-hire workers, outworkers, apprentices, trainees, work experience students and volunteers (WHS Act ss 47 and 48). Workers must be able to give views and raise matters, the PCBU must take the views into account and tell workers the outcome, and a health and safety representative must be involved where one represents the workers. Consultation specifically covers decisions on the adequacy of welfare facilities, such as the number and location of toilets, and on monitoring workplace conditions such as access, cleaning and maintenance. Where facilities exist, workers and representatives should be consulted when changes could affect their adequacy.
