Section 1: Who has WHS legal responsibilities – Australia Model Code of Practice: Healthcare and Social Assistance Industry

Australia Model Code of Practice: Healthcare and Social Assistance Industry 1.4: 1.4 Design, supply and install buildings and equipment without creating WHS risks

Designers, suppliers, manufacturers, importers and installers must ensure so far as reasonably practicable that buildings, equipment and technology used at a workplace do not create WHS risks, and must consult each other and clients: manufacturers with equipment designers, importers with designers and manufacturers, and the person commissioning construction work with the structure's designer, such as for a hospital building. Designing out risk is often the most effective control. For example an architect designing an aged care home with its client agreed to install ceiling hoists after a risk assessment, despite some residents' preference for a more home-like setting, because both owed a duty to prevent worker injury from manual people handling.
