Section 1: Who has WHS legal responsibilities – Australia Model Code of Practice: Healthcare and Social Assistance Industry

Australia Model Code of Practice: Healthcare and Social Assistance Industry 1.3: 1.3 Exercise officer due diligence

Officers, such as owners and operators of facilities, hospital directors, senior executives and board members, must exercise due diligence to make sure the organisation complies with its WHS duties (WHS Act s 27). Whether a person is an officer depends on their role and influence, not job title: owners or operators of small organisations, people who make major decisions about all or part of the organisation or affect its financial standing. Due diligence includes taking reasonable steps to acquire and keep up to date knowledge of WHS matters, including the nature of the work and common hazards, ensuring the organisation has enough resources and processes to eliminate or minimise risk and verifying they are used, and ensuring processes exist to receive and consider information about incidents, hazards and risks, verifying they are effective and responding in a timely way.
