Australia Model Code of Practice: Healthcare and Social Assistance Industry
Section 1: Who has WHS legal responsibilities – Australia Model Code of Practice: Healthcare and Social Assistance Industry

Australia Model Code of Practice: Healthcare and Social Assistance Industry 1.2: 1.2 Make worker duties known to every kind of worker in the industry

Workers must take reasonable care of their own health and safety and that of others, comply with reasonable health and safety instructions as far as they are able and cooperate with reasonable policies and procedures communicated to them. Worker means anyone who works for a PCBU, including employees, contractors, subcontractors, agency staff, managers, apprentices, gig workers, trainees, students on placement and volunteers, regardless of how they are engaged or their visa status, and covers clinical staff (doctors, nurses, midwives, ambulance and allied health and disability support workers) and non-clinical staff (security, front line, reception, kitchen, laundry and maintenance). Workers can help identify hazards and design controls but the PCBU keeps primary responsibility, and some workers such as managers may have broader delegated WHS responsibilities.
