Australia Model Code of Practice: Construction Work 2.1d: 2.1 Secure the construction workplace from unauthorised access (r 298)

A person with management or control of a workplace where construction work is carried out must ensure, so far as is reasonably practicable, that the workplace is secured from unauthorised access, having regard to all relevant matters including the risks from unauthorised access and its likelihood, and to the extent access cannot be prevented must isolate hazards within the workplace (WHS Regulations r 298). Builders and subcontractors may both hold this duty for areas they control and should agree who secures what, for example the excavator barricading trenches and the builder fencing the site, or a bricklayer removing scaffold access ladders when leaving; a person with management or control of a scaffold must prevent unauthorised access while it is incomplete or unattended (r 225(5)). Near routes used by children, a perimeter fence should be considered; fencing should be hard to climb or pass under, withstand wind, climbing and vehicle loads, and have joints and gates as secure as the panels. If a fence is left open while people are on site, risks must still be managed, for example by natural surveillance.
