An appointed investigator receives written instructions requiring a private investigator licence, compliance with state and territory law and with the provider conditions in clauses 1.19 and 1.22, collection of relevant information only, confirmation of any instruction changes, consent before exceeding instructions, adherence to the Code's surveillance standards, an up-to-date activity record consistent with privacy law, and no surveillance beyond four months, no illegal methods, threats, inducements or manipulation. Investigators may not conduct surveillance in courts, health facilities, bathrooms, changing or lactation rooms, non-public business premises or inside the home; may not intentionally film or communicate with family, neighbours, friends or colleagues (blurring incidental footage before external release); and must stop when a doctor, psychologist or other appropriate person reports harm to the claimant's health, evidence that is not used against the claim. Investigators are monitored and removed for poor conduct.
