From 26 August 2024 (or 26 August 2025 for employers that were small business employers on 26 August 2024), the employer must not directly or indirectly prevent an employee from exercising the right in s 333M of the Act to refuse to monitor, read or respond to out-of-hours contact unless the refusal is unreasonable; adverse action because of the right is prohibited and disputes go to s 333N.
