Australia Hospitality Industry (General) Award 2020 (MA000009) 15.1: 15.1 Agree a full-time 38-hour arrangement within the award's daily and cycle limits

The employer and a full-time employee must agree how the 38-hour average is worked, choosing from a 19-day month of 8 hours, 4 days of 8 and one of 6, 4 days of 9.5, 5 days of 7 hours 36 minutes, 76 hours over 2 weeks with at least 4 days off, 152 hours over 4 weeks with at least 8 days off, 160 hours over 4 weeks with 8 days off plus an accrued day off, or a combination. Every arrangement must keep ordinary hours between 6 and 11.5 a day (excluding meal breaks), give at least 48 hours off after more than 3 consecutive days of more than 10 ordinary hours, allow no more than 8 days over 10 ordinary hours in 4 weeks, and cap split-shift spread at 12 hours. The 152-hour option allows no more than 10 consecutive days without a day off and overtime for each day beyond 20 in 4 weeks. The 160-hour option allows no more than 10 days in a row, places accrued days off next to rostered days off where practicable, permits banking up to 5 and part-day use by consent, moves an accrued day off falling on a public holiday to the next day where practicable, and pays pro rata accrual (24 minutes per 8-hour day) for incomplete cycles.
