Australia General Retail Industry Award 2020 (MA000004) 33: Clause 33: public holidays under the NES, substitution by agreement and public holiday pay

Public holidays are provided by the NES. An employer and employee may agree to substitute another day or part-day for a public holiday. Work on a public holiday or a substituted day must be paid at the public holiday penalty rate in Table 12 of the current award (consolidated to 1 July 2026, read 30 September 2026), but only one of the holiday and its substitute attracts it, at the employee's choice; the same applies to part-day public holidays and their substitutes.
