To require employees to take paid annual leave during a temporary shutdown, the employer must give affected employees 28 days' written notice (or a shorter period agreed with the majority), notify later-engaged affected employees as soon as reasonably practicable, and give a written, reasonable direction to take accrued leave; the employee must comply. Unpaid leave for undirected parts requires written agreement; leave in advance may be used under 28.8. The excess leave clauses do not apply to the shutdown leave.
