An employee has an excessive accrual above 8 weeks (10 for qualifying shiftworkers). Either party may confer to reduce it. If agreement is not reached, the employer may direct leave in writing only if the direction would not reduce the balance below 6 weeks, requires periods of at least a week, starts between 8 weeks and 12 months after the direction and is consistent with agreed arrangements; the employee may still request leave. After 6 months of excessive accrual without an eliminating direction, the employee may by written notice require leave on similar limits (up to 4 weeks, or 5 for shiftworkers, in 12 months), which the employer must grant.
