Annual leave is provided by the NES and does not apply to casuals. Shiftworkers regularly rostered on Sundays and public holidays in a business rostering shifts 24 hours a day, 7 days a week, are shiftworkers for the extra NES week of leave. During paid annual leave the employer must pay, on leave accrued, an additional payment for ordinary hours equal to the greater of 17.5% of the minimum hourly rate or the minimum rate including the penalty rates (clause 22) or, for shiftworkers, shift rates (clause 25) the employee would have received.
