Part 5 and Part 6: Overtime, penalty rates and shiftwork – Australia General Retail Industry Award 2020 (MA000004)

Australia General Retail Industry Award 2020 (MA000004) 23-27: Clauses 23 to 27: shiftwork rates, paid breaks and rostering restrictions for employees engaged to do shiftwork

For employees specifically employed to do shiftwork (shifts starting from 6.00 pm to before 5.00 am, or for baking production employees from midnight to before 6.00 am, excluding same-day shifts within the span), all time on shift counts as paid time and the employer must pay the weekday, Saturday and Sunday shift rates in clause 25 of the current award (consolidated to 1 July 2026, read 30 September 2026), early morning and night rates for baking production employees in place of shift and overtime rates up to 38 hours a week and 9 a day, and public holiday rates for public holiday shifts; an employee who elects not to work a public holiday shift is absent without loss of pay, and a substitute shift may be agreed. Shiftworkers' rest and meal breaks are paid. Shiftwork rosters must not be varied to avoid public holiday entitlements, or mix shiftwork and non-shiftwork in the same week.
