An employer and employee may agree in writing that the employee takes time off instead of payment for particular overtime. The time off equals the overtime payment that would have been made (2 hours at time and a half equals 3 hours off), must be taken within 6 months at agreed times, and must be paid out at the overtime rate in the next pay period if the employee asks, if it is not taken within 6 months, or on termination. The employer must not exert undue influence or pressure about making such an agreement; a request under s 65 may also lead to one.
