Each establishment must assess, not more than once a year and at the employer's or an employee's initiative, which arrangement for averaging 38 ordinary hours best suits the business, and discuss any proposal with the affected employees aiming for agreement. Arrangements may use 38 hours a week or 76, 114 or 152 hours over 2, 3 or 4 weeks (or a longer period by individual agreement), with options such as 5 days of 7 hours 36 minutes, days of varying length, 4 hours off a fortnight, fixed, rotating or accumulating days off. Where at least 15 employees are regularly employed each week, a full-time employee must not be rostered ordinary hours on more than 19 days per 4-week cycle unless individually agreed. By individual agreement shorter days may be rostered. With majority agreement, a rostered day off may be substituted in a breakdown, power failure, unexpected spike in work or other emergency; up to 5 rostered days off a year may be banked by agreement.
