Where FSANZ needs more information to assess the application and develop the measure, or to decide whether a charge is payable, it may request it within a reasonable time; if the applicant refuses or fails to comply without reasonable excuse, the application is taken to have been withdrawn, with written notice to the applicant and, after public notice of the application, public notice of the withdrawal. The time the applicant takes to respond does not count toward FSANZ's consideration period (s 109(6)).
