Information the applicant considers confidential commercial information is marked as such, kept separate from the rest of the application electronically and in hard copy, accompanied by a written explanation of how it meets the s 4 definition and by a non-confidential summary detailed enough to be useful. Other information the applicant wants treated as confidential is identified, separated, marked 'Confidential' and supported by a statement of reasons, and the applicant says whether the authors of any unpublished manuscript know it was supplied. FSANZ may reject a claim, and s 114 allows disclosure of CCI in stated circumstances.
