The applicant should indicate, with a justification, whether approval would confer an exclusive capturable commercial benefit (s 8). Where FSANZ decides it would, the applicant must pay the cost-recovery charge fixed by the regulations (or its first instalment) within 20 business days after FSANZ's notice of acceptance, or the application is rejected (s 27(c)); any other applicant may elect to pay the charge to have consideration expedited (s 27(d)). Unpaid charges are a debt and attract late payment penalties of up to 20 per cent a year where the regulations so provide (ss 146 and 147).
