Australia Corporations Act 2001 (Cth) s912A-1d-h: s 912A(1)(d) and (h) Have adequate resources and adequate risk management systems

The licensee has available adequate financial, technological and human resources to provide the financial services and carry out supervisory arrangements, and adequate risk management systems (both civil penalty provisions). The resources duty does not apply to APRA-regulated bodies other than RSE licensees, and the risk management duty does not apply to APRA-regulated bodies except RSE licensees that are also responsible entities of registered schemes (s 912A(4), (5)).
