For each Class I permit the applicant must give the EPA Administrator a complete copy of the application, attachments and compliance plans when filing with the director (unless waived). Anyone who petitions EPA to object to a permit under 40 CFR 70.8(d) must notify the department by certified mail within 10 days, stating the grounds and whether they were raised during comment. The director may not issue a Class I permit EPA properly objects to within 45 days.
