No person may begin actual construction of, operate or modify a stationary source subject to Article 3 without a registration, permit or permit revision. A Class I permit is needed for any major source, solid waste incineration unit needing a section 129(e) permit, affected (acid rain) source or designated category; otherwise a Class II permit for sources or changes at or above the significant level for any regulated NSR pollutant (or when the director requires a permit instead of registration); otherwise registration for sources at or above a permitting exemption threshold for a regulated minor NSR pollutant or subject to a section 111 or 112 standard, with named exceptions (residential wood heaters, stationary engine NSPS and NESHAP, gasoline distribution, paint stripping, area source boilers, 112(r)). A single categorically exempt activity with trivial activities and normal farm equipment need nothing unless major. Nobody may construct or reconstruct a major source of hazardous air pollutants unless MACT will be met. Fugitive emissions count only for listed categories. Construction, but not operation, of a Class I source may begin on issuance of the proposed final permit.
