Part 4.10, specific to Western Australia, applies where a commercial vehicle (a defined class by gross vehicle mass and use) forms all or part of a workplace. The responsible person (the business, the person with management or control or the principal contractor) must ensure each commercial vehicle driver is certified fit to drive by a registered medical practitioner within the previous five years under the fitness to drive guidelines, drives within the hours of work rules (breaks totalling 20 minutes or more in each five hours of work time, one of them at least 10 unbroken minutes, a 14-day cap of 168 hours' work time, and for drivers without relief the stated non-work time in each 72-hour, 14-day or 28-day period), has a driver fatigue management plan that a competent person prepares and keeps up to date, and has their work time, breaks and non-work time recorded in the prescribed form and kept. Drivers carry matching duties.
