For section 73 of the Act the employer must tell employees, any HSR and any health and safety committee, choosing suitable ways and languages, whether it will take part in resolving issues itself or nominate an employer representative, and if so give that person's name and position description (the representative must satisfy section 73(2)(a) and (b)). If an issue arises before this notice is given and the employer is unavailable, the senior manager in the affected part of the workplace acts as employer representative. Only the HSR, or where there is none an employee nominated by the affected employees, may act for them. Any party may ask a relevant employer or employee organisation for help at any stage.
