US Occupational Safety and Health Act of 1970 11c: No discharge or discrimination against employees for exercising rights under the Act

What does 11c require?

No person may discharge or in any way discriminate against an employee because the employee filed a complaint, instituted or caused a proceeding under or related to the Act, has given or is about to give testimony in one, or exercised on their own or others' behalf any right the Act affords (including, under 29 CFR 1977.12, refusing in good faith to perform a task that a reasonable person would believe presents a real danger of death or serious injury where there is no time to seek OSHA relief). An employee who believes they were discriminated against may complain to the Secretary within 30 days; the Secretary investigates and may sue in district court for reinstatement with back pay and other relief.
