After a citation, the Secretary notifies the employer by certified mail of any proposed penalty under section 17; the employer has 15 working days from receipt to notify the Secretary that it contests the citation or penalty, failing which the citation and assessment become a final order of the Review Commission not open to review. The same 15-day rule applies to a notification of failure to abate. A timely contest, or an employee notice that the abatement period is unreasonable, goes to the Review Commission for a hearing and order. The abatement period does not run while a good-faith employer contest is pending, and 29 CFR 1903.19 requires the employer to certify abatement and, for serious violations, to document it and inform affected employees.
