Access decisions turn on person status. Under the ITAR a U.S. person is a lawful permanent resident or a protected individual under 8 U.S.C. 1324b(a)(3) (which covers citizens and nationals as well as certain refugees and asylees), an entity incorporated to do business in the United States, or a U.S. governmental entity; everyone and every entity else is a foreign person, including foreign governments and international organisations (120.62, 120.63). The EAR's general definition includes citizens, permanent residents and protected individuals, U.S.-organised entities including their foreign branches, and any person in the United States (772.1), with section-specific variants (for example 740.9). Status determination should rest on documentation and be recorded in a way that also respects U.S. anti-discrimination law in hiring, since export rules do not permit excluding protected individuals.
This control maps to 1 controls across 1 other frameworks. If you already hold one of them, the evidence you collected for it is the starting point here rather than new work.
Every mapping shown was judged rather than inferred from wording similarity, and the ones that failed review are published too. See the coverage reports and what was rejected.
The graph holds this control, the 1 it maps to, and the evidence behind each claim, over MCP and REST.
