US ITAR and EAR - Export Control and Data Security ITAR 125.5 and EAR 734.13(a)(2): Plan and control foreign visits to facilities holding controlled data

A visit by foreign persons is a release event. Under the ITAR details of proposed discussions in a plant visit must be sent to DDTC for appraisal of the technical data (125.2(a)); oral and visual disclosure of unclassified technical data during a classified plant visit needs no licence only where the visit itself was licensed or approved by the cognizant agency and the information is directly related and does not disclose design, development, production or manufacture of other articles, and unclassified data may be disclosed during an approved visit only within what was approved and never data usable for design, development, production or manufacture (125.5). Under the EAR any release of technology or source code to a visitor in the United States is a deemed export (734.13(a)(2)). Where foreign nationals are employed at or assigned to security-cleared facilities, a technology control plan supports licensing (126.13(c)).
