Parts 396 to 399: Inspection, repair and maintenance, hazardous materials driving and parking, and migrant and employee safety – US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399)

US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399) 396.7-9: No unsafe operation, roadside inspection reports (Driver Vehicle Examination Reports) certified and returned within 15 days, and out-of-service orders obeyed (396.7, 396.9)

What does 396.7-9 require?

A CMV may not be operated in a condition likely to cause an accident or breakdown, except to the nearest place where repairs can be safely made when continuing is less hazardous than stopping (396.7). An authorised inspector may inspect a vehicle at any time and declare it out of service; the driver must deliver the roadside inspection report to the carrier, the carrier must examine it, correct any violations noted, certify the corrections on the report and return it to the issuing agency within 15 days, and retain a copy for 12 months. No person may operate a vehicle declared out of service until the defects are repaired and certified.
