Every driver required to keep records of duty status must use an electronic logging device registered with FMCSA (Subpart B), except drivers who keep records in no more than 8 days of any 30, driveaway-towaway operations, vehicles with engines of model year 1999 or older, and the short-haul drivers who use time records; drivers in the exception categories use paper logs or logging software in the 395.8 format with duty status, location, miles and the carrier's name, signed and submitted within 13 days. The carrier must retain records of duty status and the supporting documents for six months, keeping up to eight supporting documents per driver per 24-hour period (bills of lading, dispatch records, expense receipts, electronic mobile communication records, payroll records) that verify the records (395.11). The carrier must give a driver access to their records on request and must not harass drivers using ELD data. A driver found without the required record or with a false record may be placed out of service (395.13).
