Part 395: Hours of service of drivers – US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399)

US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399) 395.5: Passenger-carrying driver limits: 10 hours driving after 8 consecutive hours off, no driving after 15 hours on duty, and the 60/70-hour limits (395.5)

What does 395.5 require?

A passenger carrier may not let or make a driver drive beyond 10 hours after 8 straight hours off duty, drive once 15 hours on duty have passed since those 8 hours off, or drive after 60 on-duty hours in 7 days or 70 in 8 days. The passenger-carrying sleeper berth rule allows the 8 hours off to be split into two periods of at least 2 hours each.
