Part 395: Hours of service of drivers – US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399)

US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399) 395.20-38: Electronic logging devices: technical standard, registration and self-certification, driver and carrier use, edits and annotations, data transfer at roadside, malfunctions and the 13-day driver certification (395.20 to 395.38 and Appendix A)

What does 395.20-38 require?

An ELD must meet the technical specifications of Appendix A to Subpart B, be registered and self-certified with FMCSA by its manufacturer, and be used by drivers required to keep records of duty status. The carrier must ensure drivers are trained to use the ELD, must keep the user manual, instruction sheet for data transfer and malfunction reporting and eight days of blank paper logs in the vehicle, must retain ELD records and a backup copy on a separate device for six months, and must ensure data transfer to inspectors by the telematics or local methods (395.22, 395.24). Drivers must certify each 24-hour record, may edit with annotations but may not alter driving time, and carriers may propose edits the driver must accept or reject (395.30). ELD malfunctions must be reported to the carrier within 24 hours, with the driver reconstructing records on paper and the carrier repairing or replacing the device within eight days (395.34). Unassigned driving time must be assigned or annotated (395.32).
