Part 391: Qualification of drivers – US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399)

US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399) 391.51-55: Driver qualification file contents and retention (three years after separation), and the exemptions and special rules in Subpart G (391.51, 391.53, 391.61 to 391.69)

What does 391.51-55 require?

The employer must maintain a driver qualification file for each driver containing the employment application, the motor vehicle records obtained at hire and annually, the annual review note, the list of violations, the medical examiner's certificate (or the CDL MVR showing medical status) and any skill performance evaluation or exemption, and the road test certificate or equivalent, retained for as long as the driver is employed and for three years after. The investigation history file (previous employer inquiries and responses) is kept separately with restricted access (391.53). Subpart G provides limited relief for drivers regularly employed before 1971, multiple-employer drivers, farm vehicle drivers, and drivers furnished by other motor carriers (391.61 to 391.69), each with its own documentation.
