Part 391: Qualification of drivers – US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399)

US Federal Motor Carrier Safety Regulations (49 CFR Parts 350 to 399) 391.31-35: Road test or equivalent before driving, with the certificate kept in the qualification file (391.31 to 391.35)

What does 391.31-35 require?

A person may not drive a CMV unless the employer has given the driver a road test and issued a certificate, or accepts a valid CDL (or a prior road test certificate within three years) as equivalent under 391.33. The road test must be conducted by a person competent to evaluate the driver, in the type of vehicle the driver will operate, and must cover the pre-trip inspection, coupling and uncoupling, placing the vehicle in operation, use of controls and emergency equipment, operating in traffic and while passing, turning, braking and slowing, and backing and parking. The certificate (or the CDL copy accepted in lieu) is retained in the driver qualification file.
