Before hiring, the employer must obtain a signed application for employment containing the 391.21 information, including all employers in the past three years (ten years for CDL drivers) and the driver's accident and violation history. Within 30 days of hire the employer must obtain the driver's motor vehicle record from every State in which the driver held a license or permit in the preceding three years, and must investigate the driver's safety performance history with every DOT-regulated employer of the preceding three years (general employment data, accidents and, where applicable, drug and alcohol violations under 391.23(e)), keeping the records in a separate investigation history file with controlled access and giving the driver the right to review and rebut. At least once every 12 months the employer must review each driver's motor vehicle record and the driver's list of violations (391.25, 391.27) to determine continued qualification, recording the review and the reviewer.
