US FDA Food Code 2026 3-801: 3-801 Additional safeguards for highly susceptible populations

Where a highly susceptible population is served: juice with a warning label is not served, and on-site unpackaged juice is made under a 21 CFR 120 compliant HACCP plan (children aged 9 or under in schools and day care count as highly susceptible for juice) (P); pasteurized eggs or egg products replace raw eggs in foods such as Caesar salad, sauces, mayonnaise, meringue, eggnog, ice cream and egg drinks and in recipes pooling more than one egg (P), except single-serving eggs cooked immediately, eggs baked into items such as cakes, or preparation under a HACCP plan controlling Salmonella Enteritidis; raw or partially cooked animal foods, raw seed sprouts and packaged food needing cooking under 3-401.15 are not served ready-to-eat (P); bare hand contact with ready-to-eat food is not allowed even with approval (P); time alone is not used for raw eggs (P); and food is not re-served from patients or clients under contact precautions or isolation, nor packages from others to people in protective isolation.
