Regulation on the European Health Data Space (EHDS) 16: Identify patients and professionals electronically for cross-border exchange under the 2026 identification act

Article 16 with Implementing Regulation 2026/2099 (applies from 26 March 2027): natural persons may identify to access services with any eIDAS-recognised means. Each Member State determines and notifies by 26 March 2028 its set of healthcare attributes used to match a person to their records; before requesting a MyHealth@EU exchange the professional or provider identifies the person, and for online requests authenticates them with eID at assurance level substantial (high from 26 March 2030); Member States list the entities that identify, authenticate and authorise professionals, at substantial (high from 26 March 2032); national contact points pass the attributes and professional identification data in the prescribed format. From 26 March 2029 attributes are issued to the European Digital Identity Wallet on request and providers must accept them.
