A person in the chain of responsibility who becomes aware or reasonably suspects a product is non-conforming for an intended use must notify the Commission in the approved form as soon as practicable and within 2 days (50 penalty units), including any notifiable incident it knows was or may have been caused by that use, and must comply with any Commission direction to take stated action within a stated period to remove or minimise safety risks (50 penalty units). Where a non-conforming product was or may have been the cause of a notifiable incident, notice must be given within 2 days (100 penalty units).
