Where a company has a Subdivision 2 duty, each executive officer must exercise due diligence to ensure the company complies, including reasonable steps to keep up to date on the safe use of building products, understand the company's building product activities and their safety and non-compliance risks, ensure appropriate resources and processes to remove or minimise those risks, receive and respond in time to risk information and incidents, comply with the duties, and verify those resources and processes are in use. An officer may be convicted whether or not the company is. Maximum penalty as for an individual contravening the provision.
