Each person in the chain of responsibility for a building product (a designer, manufacturer, importer or supplier who knows or should expect the product will be associated with a building; an installer in connection with relevant work; and an architect or engineer who specifies it) must, so far as reasonably practicable, ensure the product is not a non-conforming building product for an intended use. Failing to comply with a Subdivision 2 duty is an offence with a maximum penalty of 1,000 penalty units (s 74AJ).
