Where retention is withheld or security held after practical completion, the contracting party (other than a principal) must, within 10 business days before the defects liability period ends, give the contracted party a notice in the approved form stating when the period ends and, for retention, the amount to be paid if no defects need correcting and the proposed payment date. Where a subcontract's period is linked to the head contract's and the head notice arrives too late, the notice must be given within 5 business days after receiving it. Maximum penalty 100 penalty units.
