Queensland Building and Construction Commission Act 1991 s67GA-67GB: ss 67GA and 67GB Include the mandatory conditions and exclude the prohibited conditions

A building contractor (other than one contracting as principal or as the contracted party to a subcontract) must not enter a building contract that omits the conditions prescribed by regulation as mandatory for that type of contract, or includes a condition prescribed as prohibited. Mandatory conditions apply whether or not stated and override contrary terms; terms contrary to them, excluding or changing them, or deterring their enforcement have no effect; terms imposing greater obligations on the contractor are allowed. Prohibited conditions, and attempts to enforce them, have no effect. Maximum penalty 80 penalty units for each.
