Queensland Building and Construction Commission Act 1991 s67J: s 67J Give written notice within 28 days before using security or retention

The contracting party may use a security or retention amount to recover an amount owed under the contract only after giving the contracted party written notice of the proposed use and the amount owed, within 28 days after it became aware (or ought reasonably to have become aware) of the right to recover. Failing that, it may still recover by other means. The requirement does not apply where the work has been taken out of the contracted party's hands or the contract terminated, or where the security is used to pay into court under a notice of claim of charge.
