ITAR - International Traffic in Arms Regulations 126.6: Meet the conditions for FMS and foreign military aircraft and vessel exemptions

What does 126.6 require?

No licence is needed where DoD sold, leased or loaned the article or data to a foreign country or international organisation, it is delivered to that country's representatives in the United States and it leaves on that government's military aircraft or vessel or via the Defense Transportation Service (126.6(a)); foreign military aircraft and vessels may enter without a licence if no overhaul, repair or modification is performed, though overflight and naval visit approvals are needed (126.6(b)). Transfers under an FMS Letter of Offer and Acceptance need no licence while the LOA and implementing contracts are in effect, if the items are identified in the executed LOA, records are kept under Part 122, shipments by the mission or a registered forwarder carry the EEI and the prescribed invoice annotation, classified items follow the NISPOM, and defense services rest on a U.S. Government contract defining scope, case, recipients, parties and duration with the provider and subcontractors registered throughout (126.6(c)).
