Part 126: General policies, country restrictions and exemptions – ITAR - International Traffic in Arms Regulations

ITAR - International Traffic in Arms Regulations 126.1(e): Report proposed or actual sales and proposals involving proscribed countries immediately

What does 126.1(e) require?

No sale, export, transfer, reexport or retransfer, and no proposal or presentation to sell or transfer, defense articles or services may be made to a 126.1 country, its embassies or consulates, or anyone acting for it, in the United States or abroad, without DDTC approval, which is normally denied; a proposal or presentation is communication detailed enough to let a buyer decide, such as performance, price and availability; anyone who knows or has reason to know of a proposed, final or actual transaction of this kind must immediately inform the Office of Defense Trade Controls Compliance (126.1(e)), and voluntary disclosure does not reduce this duty (127.12(b)(5)).
