ITAR - International Traffic in Arms Regulations 126.5: Use the Canadian exemptions only for eligible Canadian end users and approved retransfers

What does 126.5 require?

Unclassified Canadian-origin defense articles may be temporarily imported and returned to Canada without a licence (126.5(a)). Unclassified USML articles and defense services, except those in Supplement No. 1 and exports transiting third countries, may be exported permanently or temporarily without a licence for end use in Canada by Canadian federal or provincial authorities or Canadian-registered persons, or for return to the United States, subject to registration, eligibility, 126.1 and Part 123 filing (126.5(b)); a Canadian-registered person is a Canadian national or business, a dual national of Canada and a non-126.1 country, or a registered permanent resident under the Defence Production Act, or a listed Crown corporation. Reexports or retransfers within or from Canada need prior DDTC approval, which the original exporter may grant in writing for retransfers eligible under the section, and a licence is needed where the exporter knows the article is destined for an ineligible user or another country (126.5(d)).
